Terms for Riders & Customers

These Platform Terms apply to individuals (Customers or Riders) who register with the GoCom Platform to access, review and request Ride-Hailing Services within the Federal Republic of Nigeria.

1. Introduction & Binding Terms

Welcome to GoCom Synergy (trading as "GoCom," "Company," "we," "our," or "us"). GoCom provides an electronic platform via our website (www.gocomsynergy.com) and mobile applications (collectively, the "Platform" or "Services") that connects independent transport providers (Drivers) with passengers (Riders).

By accessing or creating an account on our Platform, you agree to comply with and be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and the Company and remain effective from your first use until you stop using the Platform or your account is terminated.

As a Customer, you may access the GoCom Platform in accordance with these Platform Terms to review, request, and purchase Ride-Hailing Services from Service Providers. Also, GoCom may charge you Platform Fees for the technology services we provide to you, additional fees, such as cancellation, wait-time, or cleaning fees, may also apply as set out in in these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THIS PLATFORM. PLEASE IMMEDIATELY DEACTIVATE AND EXIT THE APP/WEBSITE.

We reserve the right, at our sole discretion, to revise, modify, or update these Terms at any time without prior notice to reflect operational, legal, or regulatory updates. Your continued use of the Platform after updates are posted signifies your acceptance of the modified Agreement.

2. Platform Nature: Intermediary Tech Service Disclaimer

GoCom is a technology service provider. We do not provide transportation services, we do not operate as a common carrier, and we are not a traditional taxi service. The Platform serves exclusively as a digital marketplace connecting Riders seeking transit with independent, third-party Drivers. GoCom does not employ Drivers; every Driver operates as an independent contractor under their own volition, schedule, and business operations.

GoCom only acts as an intermediary platform responsible for matching passengers with drivers, calculating and communicating fares, processing and forwarding payments (including cancellation and cleaning fees), and issuing receipts or invoices on the drivers' behalf. In return, drivers pay a commission to GoCom on their earnings. However, drivers operate as independent contractors who control their own schedules, are not obligated to use the platform, and remain free to provide ride-hailing services independently of GoCom.

3. User Accounts & Eligibility

To use or access the ride-hailing services, you must register for and maintain an active personal user account ("Account") and any Accounts that remains inactive or dormant for eighteen (18) consecutive months will automatically be closed.

Account Prerequisites

By registering, you guarantee and undertake that you:

  • Are at least 18 years of age or possess full legal authority to enter into binding obligations under Nigerian law.
  • Will supply true, accurate, current, and complete information, including your full name, mobile number, active email address, and valid payment information, photographic identification, address, payment method details, and tax registration status (if applicable) and You are responsible for updating or removing any such information that is no longer accurate.
  • Are solely responsible for ensuring that all information and content submitted or uploaded to the GoCom Platform by you is lawful. GoCom reserves the right to remove any illegal or unauthorized content from the Platform at any time without prior notice. If this happens, you will have the right to object as provided for under these Terms.
  • Will not use automated means (such as bots or scripts) to request rides or manipulate fare algorithms.
  • Will comply with all local, state, and federal laws of the Federal Republic of Nigeria, including all public transit guidelines.
  • Are solely responsible for safeguarding your login credentials and password. All actions taken under your account will be deemed to have been executed by you.
  • Must immediately notify GoCom at support@gocom.ng or via internal emergency app features regarding any unauthorized account access or data breach.

We reserve the right to suspend or permanently deactivate your account without notice if you breach these Terms, violate local laws, engage in fraudulent behaviors, or impact GoCom’s reputation negatively.

4. Fares, Cancellations, and Financial Terms

Subject to these Platform Terms, you may access the GoCom Platform to make requests for Ride-Hailing Services to be provided by Service Providers and may subsequently enter into agreements with them. These requests may be provided immediately or, where available, at a specified scheduled time. Customers must confirm in advance via the GoCom Platform whether they will pay for the Ride-Hailing Services.

  • Via the GoCom Platform using a registered digital Payment Method (in which case GoCom will arrange to collect amounts payable as an agent
  • In cash, by paying the relevant Driver directly, who collects the payment on behalf of the Service Provider.

Fares on the Platform are calculated based on an algorithmic combination of distance, time, traffic, and platform supply. GoCom utilizes dynamic pricing structures; you acknowledge that fares may increase significantly during periods of peak demand ("Surge Pricing").

When you request a ride, GoCom acts on behalf of the driver to calculate an estimated fare. This estimate is based on the specific route and travel time, the vehicle category you chose, whether it is an immediate or scheduled ride, and market factors like high demand or low driver availability.

Also, GoCom dispatches ride requests to nearby drivers based on the fare factors, special vehicle requests, and efficiency metrics like estimated arrival times. In high-demand locations like airports, GoCom may use a "first in, first out" queuing system to assign drivers. Additionally, drivers can set filters to only receive requests that match their preferred distances or pricing.

To ensure a smooth experience, GoCom may block matches between passengers and drivers who have previously had significant negative interactions or complaints. Your official contract with the driver begins the moment you or your goods are picked up. Once the journey starts, you are legally obligated to pay the final fare and any other applicable fees.

The final fare is calculated using the rates shown to you before the trip. However, the price may increase if you change the destination or route mid-trip, or if unexpected events like road closures extend the travel time or add toll costs. You and your driver can agree to additional lawful terms outside the app, but GoCom will not intervene in any disputes regarding those external agreements.

After a match with a Driver, if you cancel a ride after the grace period, you must pay a cancellation fee, provided the driver genuinely intended to pick you up.

Also, Drivers grant a brief grace period upon arrival at your pickup destination. Exceeding this grace period will result in automated per-minute wait-time fees appended to your final fare.

Furthermore, if you leave a vehicle soiled or damaged and the Driver provides credible, time-stamped photographic proof of damage, GoCom reserves the right to facilitate and charge a cleaning/repair fee to the Rider’s account payment method on behalf of the Driver, GoCom is authorized to collect up to ₦10,000 (Ten thousand Naira) on the driver's behalf for cleaning, though drivers or their insurers can still sue you directly for more expensive damages.

You must fulfill your payment obligations; failing to pay your driver can result in losing access to the GoCom platform or being banned from using cash payments. To accommodate different preferences, GoCom offers various vehicle categories (such as electric vehicles). Drivers can only access specific categories if they and their vehicles meet the necessary market requirements.

GoCom may occasionally offer promotional discounts and benefits. To receive a promotion's benefits, you must meet all its specific requirements and comply with GoCom's terms. GoCom reserves the right to deny promotional discounts if you engage in cheating or manipulative behavior, though your overall app access does not depend on participating in promotions.

When GoCom offers a delivery-only category, you can transport goods without riding as a passenger, provided you package the items securely and hand them directly to the driver. However, drivers will reject delivery requests, and you may be banned from the platform, if you attempt to transport prohibited items, which include:

  • Items weighing over 15kg or valued over ₦50,000.
  • Cash, securities, weapons, or illegal/unlawful goods.
  • Flammable, hazardous, or fragile materials unsuitable for a car.
  • Food, drinks, alcohol, drugs, medicines, or items requiring special legal licenses.

5. Platform Fees and Payment

GoCom also reserves the right to charge Platform fees in addition to the amounts charged for the ride. For the avoidance of doubt, Platform Fees are charged strictly for your use of the technology interface, and not for the physical transportation services themselves or for any right to use intellectual property.

These Platform fees contribute to the operation, infrastructure maintenance, and development of our technology, and may include government or regulatory levies, state taxes, or other statutory fees. The amount of the Platform Fees may change from time to time.

In the event a Platform fee is to be charged, it will:

  • Be included in the estimated total cost breakdown shown before confirmation of a ride request.
  • Become payable immediately the ride commences.

To request services on the platform, GoCom requires you to register at least one valid payment method, which you authorize the company to store for your ongoing use. To validate this payment method, GoCom may conduct verification steps, such as placing a temporary hold on a small amount of money that will be released promptly.

When you pay through the app, you authorize GoCom to instantly collect all due payments and arrange pre-authorizations for estimated fares before the service is completed. If a payment collection fails, GoCom is authorized to recover the outstanding balance the next time you log on or request a service, and your access to the platform may be restricted until the debt is fully paid. GoCom reserves the right to correct charging errors by crediting or debiting your payment method, and you agree to notify the company and return any funds sent to you by mistake.

If you choose to pay with cash, you shall be fully responsible for handing over the exact amount directly to your driver. GoCom will provide electronic receipts or invoices via email or app notifications on behalf of the service providers. However, GoCom can cancel, limit, or refuse your payments if there are reasonable grounds to suspect fraud, manipulative behavior, illegal activity, or international sanction violations, and they will try to notify you beforehand unless legally barred from doing so.

Finally, you must select your preferred payment method carefully when booking, as GoCom cannot change it after a ride request is accepted. By booking a ride, you authorize GoCom to charge your linked payment method (credit/debit card, digital wallet, or partner banking profile) immediately upon the completion of a trip, inclusive of any applicable cancellation, or incident fee. Once GoCom successfully collects your payment on behalf of a service provider, your financial obligation to that driver for the trip is officially settled.

6. Community Guidelines & Prohibited Uses

GoCom enforces a strict zero-tolerance code of conduct. You are explicitly prohibited from using the platform, services, or communication infrastructure to:

  • Engage in any unlawful, fraudulent, criminal or unauthorized activity.
  • Solicit others to perform unlawful acts, or transport illegal/contraband goods under Nigerian law.
  • Abuse, defame, slander, harass, intimidate, threaten, or discriminate against any Driver, Rider, or GoCom representative on the basis of gender, race, religion, ethnicity, age, orientation, or disability.
  • Fabricate or input false, misleading, or fraudulent identification, data, or payment details.
  • Interfere with, bypass, or compromise the safety features, software protocols, GPS signals, or security parameters of the Platform.

During a ride, You must also ensure that You or any Passenger associated with you does not constitute a nuisance and does not create unnecessary risk or discomfort the Driver or other users by:

  • Distracting the Driver unnecessarily and without justification while the vehicle is in motion.
  • Exposing others to weapons, firearms, or other inherently dangerous items.
  • Encouraging any person to violate traffic laws, speed limits, or road safety standards issued by relevant regulatory authorities.
  • Acting in any other reckless manner that shows disregard for the physical safety of others.
  • Engaging in, encouraging, or threatening any violent, aggressive, or abusive behavior.
  • Engaging in any Discriminatory Behavior based on race, religion, tribe, gender, age, orientation, or disability.
  • Initiating unwanted contact or sexual advances that make others feel unsafe or uncomfortable.
  • Exposing others to objectionable conditions, such as severe offensive odors.

For this Platform to function efficiently, we expect all Users to act in good faith and for this reason, we expect that you shall not use the GoCom Platform in any way that will disrupt, interfere, or delays the arrangement of services, including by:

  • For no just reason, ask Drivers to cancel a ride request, instead of canceling it yourself through the Customer App.
  • Excessively canceling rides after requesting them and matching with a Driver.
  • Persistently delaying the cancellation of a ride after deciding it is no longer needed.
  • Engaging with the Platform in a manner inconsistent with a genuine, good-faith intention to book Ride-Hailing Services.

Mandatory Prohibited Behavior: Offline Bookings

Riders and Drivers are strictly prohibited from arranging, negotiating, or executing rides "offline" (bypassing the GoCom tracking app system for cash transactions).

Doing so voids all integrated platform security features, tracking metrics, and insurance coverages, and serves as grounds for immediate, permanent account deactivation.

Also, the following prohibitions and restrictions further applies:

  • You are strictly prohibited from providing any false, misleading, or fraudulent information while using the platform. Additionally, you must secure your account by ensuring that no unauthorized individuals are allowed to access the GoCom platform using your unique login credentials, phone numbers, or profile details.
  • You must not engage in or facilitate any activities that compromise the platform's technical integrity. This includes attempting to falsify, scrape, index, frame, or mine any data from the platform, as well as tampering with or bypassing its security networks. Furthermore, you are forbidden from modifying, jailbreaking, decompiling, or reverse-engineering the application's source code, and you must only access GoCom through its official apps and websites.
  • You are entirely responsible for the actions of anyone riding with you, meaning you must ensure that any passengers traveling under your booking comply with these rules and do not cause you to violate the platform's terms. Any behavior that is likely to harm GoCom's brand, integrity, or reputation is strictly banned.
  • Finally, GoCom enforces a strict zero-tolerance policy against any form of hostility or manipulation. You must never threaten, intimidate, abuse, or mistreat GoCom's employees, customer support agents, or corporate business partners under any circumstances.

We reserve the right to Investigate any information indicating a breach or potential breach of these Terms, and we expect you to provide full cooperation with our reasonable investigations without undue delay.

We also reserve the right to report any unlawful, unusual, or suspicious activities to relevant Nigerian law enforcement agencies or regulatory authorities (such as the EFCC or the Police Force) without providing notice to you.

GoCom may be required to disclose confidential user information in accordance with applicable Nigerian laws, court orders, or regulatory investigations.

7. Suspension and Termination

GoCom reserves the right to immediately and temporarily suspend or restrict your access to your account, either fully or partially, under specific circumstances. This includes situations where:

you breach these platform terms, fail to verify your identity or login credentials upon request, or while GoCom conducts an ongoing safety or regulatory investigation.

Suspensions may also occur for urgent technical reasons, such as fixing system bugs, upgrading infrastructure, making software modifications to comply with new state or federal laws, or protecting the platform against imminent threats like data breaches and malware.

GoCom will attempt to notify you before suspending your account, except in emergencies involving health and safety concerns, material repeated breaches, or legal restrictions.

During any period of restriction, you will retain the ability to view your historical trip details within the app.

Your relationship with GoCom can be ended by either party under the following conditions:

By You: You can terminate the agreement immediately at any time by giving written notice to GoCom or by deleting your profile, you can view our account deletion policy by visiting https://www.gocomsynergy.com/delete-account

By GoCom: GoCom can terminate the agreement or restrict specific features by providing you with reasonable written or in-app notice. They may also terminate the relationship immediately via written notice if required by new laws and regulations, or if you commit a material or repeated breach of the platform terms.

Upon termination, you lose all rights to use the GoCom platform or request ride-hailing matches. However, termination does not erase any financial rights or debts that accrued before the account was closed. If GoCom terminates your access, you have the right to submit a complaint and request a formal review under their internal dispute rules. Furthermore, core legal provisions regarding payments, your liability, GoCom's liability, intellectual property, and dispute resolution will remain fully enforceable even after the relationship has officially ended.

8. Your Liability and Reimbursement

  • To the highest extent allowed by law, you agree to defend, cover the costs of, and fully reimburse GoCom for any legal claims, losses, financial liabilities, and damages that result from your use of the platform. This applies if GoCom faces expenses due to:
  • Your failure to follow these platform terms.
  • Any physical damage to property, personal injury, or financial loss caused by your actions.
  • Any disruption or interruption you cause to the GoCom platform.
  • Any claim that content or materials you submitted break the law or violate someone else's intellectual property rights.
  • The behavior, misconduct, or negligence of any passengers riding under your booking.

Unless stated otherwise, any money you owe to GoCom under these terms must be paid immediately upon request. If you fail to pay on time, GoCom reserves the right to charge interest on the overdue amount. This late fee will be calculated at a rate of 2% of the unpaid balance per month until the debt is settled.

9. GoCom’s Limitation of Liability

  • GoCom is not legally responsible for any losses, damages, expenses, or claims that you experience because of:
  • Your use of, or inability to use, the GoCom app and platform.
  • The app being unavailable, temporarily down, or not working properly.
  • The conduct, behavior, or wrongdoing of any independent driver or other third-party user.
  • Delays in processing payments that are outside of GoCom's control, such as issues caused by banks or third-party payment processors.
  • Someone accessing your account without permission because you failed to keep your login details secure.

This exclusion of liability means GoCom will not pay for lost profits, lost business revenue, missed contracts, damage to your reputation, inaccurate data, or any other indirect, accidental, or consequential damages. In the event that GoCom is found liable for any reason, the total amount they will ever have to pay you is strictly limited to a maximum of ₦700,000. This cap covers all claims combined, no matter how many different incidents occur.

Despite these limits, nothing in these terms removes or restricts GoCom's liability for death or personal injury if it is directly caused by GoCom's proven corporate negligence. Additionally, GoCom does not exclude any liability that cannot be legally limited under Nigerian law.

10. Intellectual Property & Software License

All core platform software, underlying code, geographical interfaces, spatial analytics mechanisms, logos, trade names, and designs are protected by intellectual property laws and remain the exclusive property of GoCom.

Subject to your ongoing compliance with these Terms, GoCom grants you a limited, non-exclusive, non-transferable, revocable license to access the application for private personal/commercial ride request processing. You are strictly prohibited from copying, reverse engineering, scraping, framing, or distributing any proprietary data or software features without prior written permission from gocomsynergy.com

11. Limitation of Liability & Exclusions of Warranties

Warranties Disclaimer

The Platform and all associated ride-matching services are provided strictly on an "as is" and "as available" basis. GoCom makes no express or implied warranties regarding:

  • The absolute availability, continuous performance, error-free nature, or perfect GPS accuracy of the Platform.
  • The quality, safety, vehicle roadworthiness, reliability, suitability, or legal compliance of independent third-party Drivers. Your use of, or inability to use, the GoCom app and platform.
  • The app being unavailable, temporarily down, or not working properly.
  • The conduct, behavior, or wrongdoing of any independent driver or other third-party user.
  • Delays in processing payments that are outside of GoCom's control, such as issues caused by banks or third-party payment processors.
  • Someone accessing your account without permission because you failed to keep your login details secure.

Limitation of Damages

Under no circumstances shall GoCom, its directors, officers, employees, or licensors be held liable for any direct, indirect, incidental, punitive, special, or consequential damages. This includes, but is not limited to, personal injury, property damage, vehicular accidents, loss of data, lost profits, or emotional distress arising out of or in connection with your use or inability to use the ride-hailing services, even if GoCom was advised of the possibility of such incidents. This exclusion of liability means GoCom will not pay for lost profits, lost business revenue, missed contracts, damage to your reputation, inaccurate data, or any other indirect, accidental, or consequential damages.

If an enforceable court proceeding determines that GoCom carries liability despite the aforementioned disclaimers, the maximum aggregate liability of GoCom to you for any and all claims shall not exceed the sum of N500,000.00 (Five Hundred Thousand Naira).

Despite these limits, nothing in these terms removes or restricts GoCom's liability for death or personal injury if it is directly caused by GoCom's proven corporate negligence. Additionally, GoCom does not exclude any liability that cannot be legally limited under Nigerian law.

12. Data Privacy, Tracking, and Regulatory Sharing

Location Services & Privacy

By using GoCom, you explicitly consent to the continuous processing, collection, and live tracking of your background and foreground geo-location data (GPS) to enable ride dispatch, accurate fare computation, and safety routing. All personal details are processed securely in alignment with our Privacy Policy and the Nigeria Data Protection Act (NDPA).

State Regulatory Disclosures

In accordance with the regulatory frameworks enacted by state transport ministries (including the Lagos State Ministry of Transportation), GoCom is legally obligated to integrate API protocols and share live datasets with regulatory authorities. This data may include real-time vehicle coordinates, active trip manifests, driver credentials, and passenger transaction details for city management and civil safety enforcement. By accepting these terms, you grant GoCom full authorization to fulfill these statutory compliance obligations.

Electronic Communications & SMS

  • By registering an account, you consent to receive electronic communication from us via email, automated in-app push alerts, and Short Message Service (SMS) text messages.
  • Text messages may be dispatched via automated dialing systems to confirm your device verification code, send safety indicators, or notify you of outstanding transaction payments.
  • You confirm that the provided telephone number belongs to you and is accurate.
  • You are solely responsible for any data or SMS messaging network rates applied by your telecommunications provider.
  • You may withdraw your electronic document consent via email to support@gocom.ng , which may result in the deactivation or restriction of your account.

13. Governing Law

These Terms of Service and any separate platform agreements through which we provide services to you shall be governed by, interpreted, and construed exclusively in accordance with the laws of the Federal Republic of Nigeria.

14. Dispute Resolution

In the event of any operational conflict, payment grievance, or legal dispute, you agree to first contact GoCom through our official communication channels to seek a direct, amicable resolution. Both parties will share necessary documentation and cooperate in good faith to resolve the complaint.

If an attempt to reach an amicable settlement fails and written notice is issued by either party, the dispute shall be referred to the Lagos Multi-Door Courthouse (LMDC) for formal mediation. The mediation process will be conducted in strict accordance with the LMDC Mediation Procedure Rules or other mutually agreed alternative dispute resolution channels in Nigeria.

15. Severability & Full Agreement

If any singular provision or clause within these Terms is determined by a court of competent jurisdiction to be illegal, void, or legally unenforceable, that provision shall nonetheless be enforced to the highest extent permitted by applicable law. The unenforceable segment will be deemed severed, and it will not impact the legal validity and enforceability of the remaining provisions.

These Terms, alongside the operational rules and Privacy Policy posted on our interface, constitute the entire legal agreement and understanding between you and GoCom, superseding any prior verbal agreements, draft guidelines, or historical communications.
