These Platform Terms govern how independent Service Providers and their Appointed Drivers register with, access and fulfil Ride-Hailing Services through the GoCom Platform.

Welcome to GoCom Synergy (trading as "GoCom," "Company," "we," "our," or "us"). These Platform Terms constitute a legally binding agreement between GoCom and individuals or legal entities operating as independent transportation providers (“Service Providers” or “you”) who register with the GoCom Platform to access, review, and fulfill opportunities to provide Ride-Hailing Services to Customers within the Federal Republic of Nigeria.
These Terms take effect and apply to you from the date you first register as a Service Provider They remain in effect until terminated by either party and fully supersede all previous versions of the Platform Terms.
IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM ACCESSING OR USING THIS PLATFORM.
GoCom reserves the right, at its sole discretion, to revise, modify, or update these Terms or the features of the Platform at any time. We will provide you with at least fifteen (15) days’ notice before any significant changes take effect. If you do not agree with the modified terms, you have the right to terminate your relationship with GoCom immediately.
However, we may implement changes to these Platform Terms or the application immediately and without prior notice if the adjustments are merely aesthetic, improve basic functionality, introduce temporary testing features, or are urgently required to address cybersecurity risks, data breaches, imminent dangers to Users, or changing state or federal regulations. Your continued use of the Platform after updates are posted signifies your explicit acceptance of the modified agreement.
GoCom is a technology service provider. We do not provide transportation services, we do not operate as a common carrier, and we are not a traditional taxi service. The Platform serves exclusively as a digital marketplace connecting independent Service Providers with Customers seeking transit.
GoCom does not employ Drivers; you acknowledge that every Driver operates as an independent contractor under their own volition, schedule, and business operations. Nothing in these Terms obliges you to log onto the platform, review opportunities, or accept any ride requests, nor does it prevent you from providing ride-hailing services independently of GoCom.
By accessing the GoCom Platform, you appoint GoCom to act as your commercial agent for the explicit purpose of facilitating the sale of Ride-Hailing Services to Customers. In this capacity, you grant us the authority to:
To access the ride-hailing marketplace, you must register for and maintain an active personal user account. Your right to access the platform is strictly conditional upon providing GoCom with all documentation reasonably required to verify your eligibility to lawfully operate in your market, including valid photographic identification, valid driver’s license, proof of the right to work, business details, and tax registration status.
You guarantee that all information provided is true, accurate, and kept up to date. You are solely responsible for safeguarding your login credentials, and any actions taken under your account will be deemed to have been executed by you.
Where the features are available, you may register and appoint individuals to fulfill Ride-Hailing Services on your behalf as "Appointed Drivers". If a driver accesses the platform on behalf of another entity, that entity is recognized as the legal Service Provider under these terms. You remain fully responsible for the acts, omissions, and legal compliance of your Appointed Drivers as if they were your own. In respect to each Appointed Driver, you are solely responsible for:
GoCom reserves the right to refuse the registration of a Service Provider or an Appointed Driver if that individual has previously been banned or had an account terminated for a material breach of GoCom’s terms on another profile.
When a Customer requests a trip, GoCom acts on your behalf to calculate an estimated fare based on an algorithmic combination of distance, travel time, requested vehicle category, and real-time market factors like supply and demand. GoCom utilizes dynamic structures, and fares may increase significantly during high-demand periods ("Surge Pricing").
Ride requests are dispatched to nearby drivers based on proximity, arrival efficiency, and driver filters. In high-demand locations like airports, GoCom may implement a visible "first in, first out" queuing system.
To ensure user safety, GoCom may block matches between drivers and passengers who have previously logged significant negative feedback or complaints against each other.
When an invitation is sent via the Driver App, it will clearly display the applicable Fare, pick-up location, destination, and whether the customer is paying by cash or a digital method. A legally binding agreement for the ride is formed between you and the customer the moment you or your Appointed Driver indicate an intention to fulfill the request via the app. The final fare is calculated using the rates shown before the trip, but may increase if the route or destination is altered mid-journey, or if road closures add unexpected travel time or toll costs. You agree not to dishonestly demand additional cash or separate payments from customers outside the app interface.
If a customer cancels a ride request after the platform’s designated cooling-off period, you are entitled to a Cancellation Fee. GoCom’s obligation to collect this fee is strictly conditional upon your genuine intention to fulfill the ride; no fee will be collected if the driver made no reasonable attempt to reach the pick-up spot.
Furthermore, you may charge a Customer a Cleaning Fee of up to Naira Five Thousand (₦5,000) if a passenger leaves your vehicle soiled or stained. To collect this fee, you must promptly notify our Support Team through the app and provide credible, time-stamped photographic evidence along with a tax-compliant receipt. This does not prevent you from seeking additional legal remedies or insurance compensation directly from the customer for extensive vehicle damage.
In exchange for using GoCom's technology interface, infrastructure, and matching services, you agree to pay GoCom a Commission on all amounts payable to you by Customers, excluding commission-free items such as cleaning fees, tips, and tolls. The initial commission rate is provided to you upon registration, and any subsequent updates to the rate will be communicated in writing at least fourteen (14) days before taking effect.
Your obligation to pay the commission arises immediately when a trip becomes payable, and you authorize GoCom to automatically deduct this fee from any digital payments collected on your behalf.
GoCom tracks your transactions via an automated Account Balance. If your balance is positive at the end of the day, GoCom will transfer your earnings to your registered local bank account. To minimize administrative bank charges, GoCom is not required to forward your balance if it falls below the minimum threshold set in the platform. Where available, you may request an "Early Payment" of your earnings through the app prior to the standard daily schedule, which may be subject to a processing fee displayed to you in advance.
For trips where the Customer selects a digital payment method, the customer’s financial obligation to you is fully discharged once the payment is successfully processed into GoCom's accounts. GoCom is not responsible for, nor do we guarantee, payments from failed third-party transaction methods. If a customer's payment fails, all services were provided at your own financial risk, though GoCom will offer reasonable administrative assistance to help recover the debt.
For cash trips, you are solely responsible for collecting the exact fare directly from the driver or passenger. To prevent excessive outstanding debts, your right to accept cash trips is strictly limited to periods when your Account Balance remains above the required threshold. If your account falls into a negative balance exceeding the maximum debt threshold, you must immediately reimburse GoCom via bank transfer; failure to do so will result in immediate account restrictions. GoCom also reserves the right to correct charging or payment errors by adjusting or debiting your future Account Balance.
GoCom maintains a strict zero-tolerance code of conduct across its communication channels and operational network. You are explicitly prohibited from using the platform to engage in any unlawful, fraudulent, or criminal activity under Nigerian law.
During all service periods, you and your Appointed Drivers must ensure you do not create safety risks or cause unnecessary discomfort to users. Prohibited behaviors include:
Furthermore, all users must act in good faith to preserve the efficiency of the marketplace. Drivers must not disrupt the platform by excessively remaining online while inactive, repeatedly delaying cancellations, or improperly asking customers to cancel a trip on their app instead of canceling it properly through the Driver App. Service Providers and Drivers are strictly prohibited from arranging, negotiating, or executing rides "offline" by bypassing the app’s tracking system. Doing so voids all integrated platform security features, tracking metrics, and insurance coverages, and serves as grounds for immediate, permanent account deactivation. Technical manipulation, data scraping, indexing, falsifying GPS data, or attempting to reverse-engineer GoCom's proprietary software code is strictly forbidden.
GoCom reserves the right to thoroughly investigate any account data or user feedback indicating a potential breach of these terms. You are required to provide full and prompt cooperation with any reasonable company inquiry. We reserve the absolute right to report any suspicious, fraudulent, or illegal activities directly to relevant Nigerian law enforcement or regulatory authorities (such as the EFCC or the Police Force) without providing notice to you. GoCom may also disclose confidential user data when required by applicable laws, court orders, or state regulatory frameworks.
GoCom is entitled to immediately suspend or restrict your account access, in whole or in part, if you or your Appointed Drivers breach these terms, fail to verify identity credentials upon request, or while GoCom is conducting an ongoing legal or safety review. Urgent technical suspensions may also be implemented to deploy software patches, fix system bugs, upgrade database infrastructure, or respond to immediate malware or cybersecurity threats. GoCom will attempt to notify you before a suspension occurs, except in emergencies involving imminent health and safety risks, repeated material breaches, or legal restrictions. During any suspension period, you will retain the ability to view your historical trip records within the app.
Your relationship with GoCom can be ended under the following terms:
Upon termination, you and your Appointed Drivers lose all rights to access the platform. Termination does not erase any financial debts or rights that accrued prior to closure. If you disagree with a removal, suspension, or termination decision, you have the right to submit a formal complaint and request a review under GoCom's internal dispute handling rules. Core legal provisions regarding payments, commissions, liability, intellectual property, and jurisdiction remain fully enforceable after the relationship ends.
To the maximum extent permitted by law, you agree to indemnify, defend, and fully reimburse GoCom, its directors, and affiliates for any legal claims, losses, financial liabilities, costs, and damages (including professional advisory fees) incurred as a result of your use of the platform. This indemnification applies if GoCom faces expenses arising directly or indirectly from:
Unless stated otherwise, any money owed to GoCom under these terms must be paid immediately on demand. GoCom reserves the right to recover these sums by deducting them from your collected earnings or issuing separate invoices. Any late payment of sums payable to GoCom shall accrue an interest fee, if imposed by GoCom, calculated at a rate of 2% of the unpaid balance per month until the entire debt is cleared.
The GoCom Platform and all associated ride-matching features are provided strictly on an "as is" and "as available" basis.
GoCom makes no express or implied warranties regarding continuous app performance, error-free interfaces, perfect GPS accuracy, or the availability of consistent ride opportunities in your market.
Furthermore, GoCom does not guarantee or accept responsibility for the safety, financial reliability, legal compliance, or personal conduct of independent customers or passengers using the application.
GoCom makes no express or implied warranties regarding:
GoCom shall not be legally responsible to you or your Appointed Drivers for any losses, damages, expenses, or claims arising out of your use or inability to use the platform.
This includes total exclusion of liability for lost profits, lost business revenue, missed commercial contracts, damage to professional reputation, inaccurate mapping data, or any other indirect, incidental, or consequential damages.
Under no circumstances shall GoCom, its directors, officers, employees, or licensors be held liable for any direct, indirect, incidental, punitive, special, or consequential damages. This includes, but is not limited to, personal injury, property damage, vehicular accidents, loss of data, lost profits, or emotional distress arising out of or in connection with your use or inability to use the ride-hailing services, even if GoCom was advised of the possibility of such incidents.
This exclusion of liability means GoCom will not pay for lost profits, lost business revenue, missed contracts, damage to your reputation, inaccurate data, or any other indirect, accidental, or consequential damages.
In the event that GoCom is found legally liable by a competent court of law despite these disclaimers, GoCom’s maximum aggregate liability to you for any and all claims combined is strictly capped at a maximum of Five Hundred Thousand Naira (₦500,000). This cap applies regardless of the number of separate events giving rise to liability.
However, nothing in these terms limits or excludes GoCom’s liability for death or personal injury if caused directly by GoCom's proven corporate negligence, nor does it exclude any liability that cannot lawfully be limited under applicable Nigerian laws.
All core platform software, underlying code, geographical interfaces, spatial analytics mechanisms, logos, trade names, and designs are protected by intellectual property laws and remain the exclusive property of GoCom.
Subject to your ongoing compliance with these Terms, GoCom grants you a limited, non-exclusive, non-transferable, revocable license to access the application for private personal/commercial ride request processing. You are strictly prohibited from copying, reverse engineering, scraping, framing, or distributing any proprietary data or software features without prior written permission from GoCom.ng
By using GoCom, you explicitly consent to the continuous processing, collection, and live tracking of your background and foreground geo-location data (GPS) to enable ride dispatch, accurate fare computation, and safety routing. All personal details are processed securely in alignment with our Privacy Policy and the Nigeria Data Protection Act (NDPA).
In accordance with the regulatory frameworks enacted by state transport ministries (including the Lagos State Ministry of Transportation), GoCom is legally obligated to integrate API protocols and share live datasets with regulatory authorities. This data may include real-time vehicle coordinates, active trip manifests, driver credentials, and passenger transaction details for city management and civil safety enforcement. By accepting these terms, you grant GoCom full authorization to fulfill these statutory compliance obligations.
By registering an account, you consent to receive electronic communication from us via email, WhatsApp, automated in-app push alerts, and Short Message Service (SMS) text messages. Text messages may be dispatched via automated dialing systems to confirm your device verification code, send safety indicators, or notify you of outstanding transaction payments.
You confirm that the provided telephone number belongs to you and is accurate.
You are solely responsible for any data or SMS messaging network rates applied by your telecommunications provider.
You may withdraw your electronic document consent via email to support@gocom.ng, which may result in the deactivation or restriction of your Account.
These Terms of Service and any separate platform agreements through which we provide services to you shall be governed by, interpreted, and construed exclusively in accordance with the laws of the Federal Republic of Nigeria.
In the event of any operational conflict, payment grievance, or legal dispute, you agree to first contact GoCom through our official communication channels to seek a direct, amicable resolution. Both parties will share necessary documentation and cooperate in good faith to resolve the complaint.
If an attempt to reach an amicable settlement fails and written notice is issued by either party, the dispute shall be referred to the Lagos Multi-Door Courthouse (LMDC) for formal mediation. The mediation process will be conducted in strict accordance with the LMDC Mediation Procedure Rules or other mutually agreed alternative dispute resolution channels in Nigeria.
If any singular provision or clause within these Terms is determined by a court of competent jurisdiction to be illegal, void, or legally unenforceable, that provision shall nonetheless be enforced to the highest extent permitted by applicable law. The unenforceable segment will be deemed severed, and it will not impact the legal validity and enforceability of the remaining provisions.
These Terms, alongside the operational rules and Privacy Policy posted on our interface, constitute the entire legal agreement and understanding between you and GoCom, superseding any prior verbal agreements, draft guidelines, or historical communications.
